By choosing this com type you agree to give me artistic freedom with your OC!You may request specific outfits (or nude), let me know their personality, and point out details you want to make sure I dont miss! The pose and and level of detail is ultimately up to me, though! Overly complex designs /will/ be simplified!Will be colored with a very simple BG, you will also receive a WIP before I call it done just to make sure it is in the realm of what you want!This is perpetually experimental!! I try my best to be consistent but pixel art makes my style vary slightly from piece to piece based on what I think looks best!
SCRATCHBITE TERMS OF SERVICE
By commissioning me in any way you are confirming you have read and agree to the terms of service below.
1. I, the artist, have the right to refuse any commission request, without needing to explain the reason.2. I reserve the right to stop work on a commission and/or cancel a commission request due to poor communication, rude/inappropriate behavior, or a breach of ToS. Cancelations due to the reasons listed above that happen beyond the sketch phase will not receive a refund.3. By commissioning me, the client is purchasing artistic labor only. I, the artist, retain all rights to the commission, which includes but is not limited to: Distribution, reproduction, and use of the commission for artist promotion across websites UNLESS discussed otherwise between myself and the client beforehand.4. The client must specify the content of their commission to the best of their ability prior to a commission agreement. A complex commission may incur additional illustration fees, to be defined and agreed upon in the commission agreement prior to start of work.5. The client needn't specify the display size of the commission, but large display size requests may incur additional illustration fees.6. If the commission is time-sensitive, a rush fee may be applied, to be defined and agreed upon prior to start of work.7. If the commission is defined as confidential in the commission agreement, I will temporarily delay public display of the image at the request of the client and as defined in the commission agreement until such time the commission agreement specifies public display is permitted. If the commission is defined as private and is not to be posted anywhere at any time, a privacy fee may be applied.8. The client may not distribute, reproduce, or otherwise profit from the commission beyond the resale of the original character the art piece belongs to. For custom character designs made by me, the resale of the original character may only surpass its original purchase price if there is additional art pieces to increase its value.9. Art commissioned from a client may be used on display such as profile pictures, banners, streaming assets, and personal use so long as credit using my handle "Scratchbite" is provided in the profile description/bio/stream or video information boxes. You do not need to ask for permission unless printed physically.10. Digital art commissions will be provided to the client via stash download link or you may request it sent via email; this does not include the commission native files ( .psd, .csp, etc.), unless agreed upon in the commission agreement, or thereafter, the client obtains written permission from me.
I am not responsible for the cost of shipping a commission (traditional art commissions or any digital media device [e.g. CD, DVD, flash drive, etc.] or print of a digital art commission); the client is responsible for all shipment costs.11. If the commission is for commercial purposes I must be notified prior to the start of work. Commercial use of the commission will be decided on a case-by-case basis. New terms may be written and agreed upon in a commercial purpose commission agreement before the start of work.12. The client may request a WIP (Work in progress) preview of the commission at any time during the creation process and may ask for a small number of changes after starting work, though the client may be subject to additional fees for what I, the artist, determine as an excessive amount of change requests before and/or after the piece is finished as applicable.13. Refunds may only be issued if the client notifies me of cancellation prior to the first WIP sent. Partial refunds may be issued on a case-by-case basis after the first WIP sent but before the finished piece is complete. No refunds will be issued after a piece is finished, nor will a refund be issued before or after start of work if any of these terms of service are breached. Additionally, I have the right to revoke access to and/or stop work of the commission at any time after start of work if these terms of service are breached.14. Absolutely NO minting/NFT of or inspired by my works.15. Clients are expected to wait anywhere between a week and 2 months for work completion on a single piece of art. Beyond 2 months of waiting, clients are within their right to request a full refund regardless of the state of completion the owed work is in so long as there has been no breach of ToS, unless otherwise agreed upon before the 2 month mark.
